Dismissed Without Giving Up a Weeknight

You drove out to Germantown for Trader Joe’s or Saddle Creek, got stopped on Poplar on the way, and now you have a court date in a city you do not live in. That is the call we take most often out of this city.

Germantown Municipal Court sits Wednesdays at 5:00 p.m. in the Council Chambers at City Hall. Evening dockets are rare around here, and that single fact shapes everything about handling a ticket in Germantown.

A five o’clock docket means leaving work early, sitting through a full call, and getting home late on a weeknight. For a speeding citation.

None of that has to happen. We appear in your place and the ticket gets dismissed.

What a dismissal looks like

Dismissed outrightNo court costs, no conditions.
Dismissed with court costsThe usual resolution. The charge goes away and you pay the court its costs.
Dismissed with costs and driving schoolOn a higher speed, where the prosecutor needs something more than costs. A defensive driving course as part of the deal.

How far over the limit you were is what decides which of the three you get.

Before You Pay It

Mailing a Check Is a Guilty Plea

It looks like a bill. It is a plea, and it is final the moment you send it.

A judgment is entered against you and it lands on your record with points. Your insurer could reprice the policy at renewal. There is no version of that you can undo later.

Paying feels like making it go away. It is the one choice that makes it permanent.

Practical

Where It Meets, and When

Most of what comes to us out of Germantown was written on Poplar, Germantown Road or Farmington. The department runs over 100 sworn officers with its own dispatch and detective division.

Check who wrote it first. A citation from Germantown Police is heard in Germantown Municipal Court. A citation from the Shelby County Sheriff or the Tennessee Highway Patrol goes downtown to 201 Poplar instead, even though you were stopped here. The agency is printed on the citation.

The evening setting is what catches people. They assume a weekday morning, plan around that, and miss the call. Miss it and the court enters a judgment against you, which is where paying the ticket would have landed you anyway.

Common Questions

Germantown Speeding Tickets: What You Need to Know

Can you get my Germantown speeding ticket dismissed?

That is what usually happens. A dismissal can come outright, with court costs, or with court costs and a defensive driving course where the speed calls for it.

Can you guarantee my ticket will be dismissed?

No. Attorneys are not permitted to guarantee an outcome, and anyone who does is breaking a rule they are bound by. What we can tell you is what has happened in cases like yours in this court. Call and describe the citation and you will get a straight answer.

Do I have to go to court in Germantown?

No. We appear for you. That is the main reason people hire someone for a ticket.

How much does it cost?

$500. Court costs, where they apply, are set by the court and are separate from the attorney fee.

Why does Germantown court meet at night?

Municipal Court sits in the Council Chambers at City Hall on Wednesdays at 5:00 p.m. Evening dockets are rare, so it catches people out constantly. Most courts around here sit during business hours and people plan around that without checking.

Does the evening docket mean I can go after work?

You could, but it means leaving early anyway and getting home late, and you would be giving up an evening to do what an attorney can do without you. Most people would rather not spend a Wednesday night in Council Chambers.

I have a CDL. Is this different?

Yes. Tennessee gives commercial drivers no deferral and no diversion, which means a CDL citation has to be tried rather than negotiated. Different case, different fee. Call before the court date.

I live in Memphis and got stopped driving out to Saddle Creek. Where does the case go?

That depends on who wrote it, not on where you live. A Germantown Police citation is heard in Germantown Municipal Court on a Wednesday evening. A Shelby County Sheriff or Tennessee Highway Patrol citation goes to 201 Poplar instead. Look at the agency on the citation before you plan around a court date.

What happens if I just pay it?

Paying is pleading guilty. A judgment is entered against you, it goes on your driving record with points, and your insurer could raise your rate at renewal. It is also the only option you cannot undo.

What about points on my license?

Tennessee scales them to how far over the limit you were. One to five over is 1 point, six to fifteen is 3, sixteen to twenty-five is 4, twenty-six to thirty-five is 5, thirty-six to forty-five is 6, and forty-six or more is 8. Six points in a rolling twelve months brings an advisory letter from the Department of Safety. Twelve brings a notice of proposed suspension, with a hearing and sometimes a defensive driving course as the alternative. A dismissal carries no points at all.

I do not live in Germantown. Does that matter?

Only in that it makes hiring someone more useful. Most of the people we handle these for live somewhere else. The whole point is not making the drive.
